We provide access to the website and sell products to users of the website (you or your) subject to the terms and conditions set out below (Terms and Conditions).

By buying products from the website, you agree to be bound by these Terms and Conditions.
Your Account
In order to buy products from the website and to use certain features of the website you will need to register for an account with a username and password. You are responsible for maintaining the confidentiality of your account and password and preventing unauthorised access to your account. You accept responsibility for all use of your account. You must take all necessary steps to ensure that your password is kept secure and must tell us immediately if you believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
If you are under sixteen, you may use the website only with the permission and supervision of a parent or guardian. Raw Sports reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at its discretion. If we cancel an order, it will be without charge to you.
Privacy
Please review our privacy policy which, together with the fraud prevention section below, explains how the personal information we collect from you will be used.
Our Contract
When you place an order to purchase a product from the website, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send an email to you confirming that we have accepted the order (the Confirmation Email). Such acceptance will be complete at the time we send the Confirmation Email to you.
You are offering to enter into a contract with Raw Sports when you place an order. The contract is legally binding when your order has been accepted by us and we have sent you the Confirmation Email.
Raw Sports will retain the title in the products until full payment has been made by you and has been received by Raw Sports.
Fraud Prevention
By placing your order, you confirm that you have read, understood and agree to these Terms and Conditions and that you consent to your personal information being used by us, our third-party service providers in order to fulfil your order and as set out in our privacy policy.
Your personal information including your full name and address, your bank account and card payment details and your sensitive personal data will be used for fraud prevention, fraud screening and age and identity verification purposes. This personal information may be disclosed to and used by fraud prevention agencies for all such purposes and those agencies may keep a record of it where permitted by the Data Protection Act 1998 (as amended and/or replaced from time to time). This personal information will also be disclosed to third parties providing fraud prevention, fraud screening and age and/or identity verification services to us.
If you give us false or inaccurate information about yourself and if we suspect fraudulent payments and/or identity fraud we will record this and may also pass this information to organisations involved in crime and fraud prevention.
Deliveries and Returns
At the point of checkout you will be informed of your estimated delivery date(s), which will be within 30 days after the date of the Confirmation Email. Occasionally our delivery to you may be affected by an event outside our control. See below for our responsibilities when this happens.
Delivery of an order shall be completed when we deliver the products to the address you gave us or you collect them from us, or a nominated third party, and the products will be your responsibility from that time.
If you are a consumer and we fail to deliver products within 30 days of your order then you may cancel your order and we will provide you with a full refund of the price of your products and any delivery costs.
With your purchase of Raw Sports products, you will receive a delivery note and returns form. To return items to us fill out your returns form as instructed, include the returns form in the package and attach the label (including your order number) to the outside of the package then send it back to us. If you do not have your delivery note or returns form, our returns team will be happy to send you electronic copies for you to print off at home. You can contact them at wot@raw-sports.com
All products are returned to us at your own risk and cost, and you are therefore strongly advised to get proof of postage. If your return is lost in post then you'll need to contact the carrier to pursue their claims procedure.
International Orders
We currently offer delivery to selected international destinations. The cost of delivery and timescales will vary depending on your country.
Purchases from the website may be in British Pounds (£ GBP). Banks and international credit/debit card issuers will determine any exchange rates and may impose further charges, which you will be liable to pay.
Additional taxes, fees, levies or charges may apply depending on your local legislation. If you have made an international order you may have to pay import duty or formal customs entry fees. Customs or import duties are usually charged once your ordered products reach your destination country. These charges are your responsibility and must be paid by you prior to delivery of your ordered products. Raw Sports has no control over these charges and we cannot tell you what the cost would be of these due to the different customs and import policies between countries.
Some countries also have import restrictions on certain products or materials. You are responsible for determining whether there are any restrictions on delivery of any Raw Sports products to your country. You can contact your local customs office for assistance regarding these matters.
Delivery may be delayed by local customs or other circumstances out of our control. Raw Sports shall have no liability for any delay or failure to deliver your products if the delay or failure is wholly or partially caused by circumstances that are out of our control.
International orders can only be delivered to the same country that your payment method is registered to. As part of our security measures, you may be asked as an international customer to provide proof of your billing address. This will need to display your name and your address matching that of the person who has placed the order.
As an international customer, if you return your products to us, refunds will be issued to you in the currency in which you originally paid for your purchase. Banks and international credit/debit card issuers determine all exchange rates.
International returns to us are at your cost and you should keep evidence of having sent the items, such as a certificate of posting. In all cases the items you return must be in their original condition.
Nothing in this clause overrides or otherwise affects any statutory or consumer rights you may be afforded in your individual country.
Business Returns
This section only applies if you are a business customer (any customer other than a consumer):
[You may return new, unworn or unused products within 14 days from the date on which the goods were shipped to you.]
All goods must be returned to us unused, together with all original packaging (please note you have a duty to take reasonable care of returned goods and any refund may be withheld or a charge incurred if you fail to take such care and damage the goods). Please make sure that your return package is packed and sealed securely (in or with the original packaging if possible).
Consumer Returns
This section only applies if you are a consumer.
If you are a consumer, you have a legal right to cancel your contract under the Consumer Rights Act 2015 during the period set out in the paragraph below. This means that during the relevant period if you decide for any reason that you do not want to receive or keep a product, you may cancel the contract and receive a refund. The right to cancel does not apply to items which have been manufactured to your specification.
If you have bought a single product you may cancel up to 14 days after the day on which you receive the product. If you have bought multiple products which are delivered on separate days you may cancel up yo 14 days after the day on which you receive the last instalment of the last of the separate products ordered.
If you send a cancellation notice by e-mail or by post your cancellation is effective from the date you send us the e-mail or post the letter to us. If you contact us by telephone to cancel then your cancellation is effective from the date on which you call us.
If you cancel we will refund you the price you paid for the products less any reduction in the value of the goods if this has been caused by your handling them in a way which would not be allowed in a shop. We will also refund any delivery costs although the maximum refund will be the costs of delivery by the least expensive delivery method we offer.
We will make any refunds due to you as soon as possible, in any event within 30 days from the day on which we recieve your returned products to us.
We will refund you using the same method you used to pay for the products. If you used vouchers to pay for the product we may refund you in vouchers. You must return the applicable product(s) to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel your contract.
Unless the product is faulty or not as described you will be responsible for the cost of returning the products to us. If we have offered to collect the product from you, we will charge you the direct cost to us of collection.
Because you are a consumer, we are under a legal duty to supply products that are in conformity with the contract. As a consumer, you have legal rights in relation to products that are faulty or not as described. These legal rights are not affected by your right of return and refund or anything else in these Terms and Conditions.
Feedback and Complaints Policy
We welcome any comments about our service. If you have reason to complain about our service, please e-mail wot@raw-sports.com or call 01594 822493. We aim is to respond to your complaint within fourteen working days, either resolving the complaint, or with a timescale for resolution.
Pricing and Availability
All prices are quoted in Pounds sterling and are inclusive of VAT unless otherwise specified. All item prices are exclusive of delivery charges. We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that shipping dates are estimates only. Unless otherwise stated, dispatch dates are not guaranteed and should not be relied upon. As we process your order, we will inform you by email if any products you order are subsequently found to be unavailable.
Despite our best efforts, a small number of the products on the website may be incorrectly priced. If a product's correct price is lower than our stated price, we will charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping the products or cancel your order and notify you of such cancellation.
Customs
When ordering products from the website for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you as we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact the local customs office for further information. Additionally, please note that when ordering from the website, you are considered the importer of record and must comply with all laws and regulations of the country in which the products are received.
Disclaimer and Limitation of Liability
This website is provided by Raw Sports on an 'as is' and 'as available basis'. Raw Sports makes no representations or warranties of any kind, express or implied, as to the operation of this website or the information or content on this website, unless such warranties cannot be excluded by law. It is expressly agreed by you that your use of this website is at your sole risk.
Raw Sports does not warrant that this website, its servers, or e-mail by us are free of viruses or other harmful components. Raw Sports will not be liable for any damages of any kind arising from the use of this website (other than in relation to the sale of products) including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
Our Liability if you are a Business
This only applies if you are a business customer (anyone other than a consumer).
Nothing in these Terms and Conditions limits or excludes our liability for:
• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or
• defective products under the Consumer Protection Act 1987.
Subject to the preceding paragraph, we will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
• any loss of profits, sales, business, or revenue;
• loss or corruption of data, information or software;
• loss of business opportunity;
• loss of anticipated savings;
• loss of goodwill; or
• any indirect or consequential loss.
Subject to the remainder of this section, our total liability to you in respect of all losses arising under or in connection with your contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the products.
Except as expressly stated in these Terms and Conditions, we do not give any representation, warranties or undertakings in relation to the products. Any representation, condition or warranty which might be implied or incorporated into these Terms and Conditions by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the products are suitable for your purposes.
Our Liability if you are a Consumer
This section only applies if you are a consumer.
If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions and or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the contract.
We only supply the products for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not in any way exclude or limit our liability for:
• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);
• any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and
• defective products under the Consumer Protection Act 1987.
Electronic Communications
When you visit the website, or send emails to us, you are communicating with us electronically. We will communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All rights, including copyright and other intellectual property rights, in and to this website are owned by or licensed to Raw Sports unless otherwise stated.

Events Beyond our Reasonable Control
Raw Sports will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
No Waiver
If you breach these Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Governing Law and Jurisdiction
Your use of the website, any purchase by you on the website of any products and these conditions will be governed by and construed in accordance with the laws of England and Wales and will be deemed to have occurred in England. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.
Your statutory rights are not affected by these Terms and Conditions.
